With the circular letter of 27 July 2020, the Abi focused attention on the topic of silent consent for the suspension of the mortgage for the purchase of the first home.
In the circular dated 27 July 2020, the ABI reported the FAQs subject to intervention by the Ministry of Economy and Finance, which on 22 July 2020 published on its website the updated FAQs on the subject of suspension of mortgages and/or financing for businesses and families and on the SME Guarantee Fund. Particular reference is made to the Mortgage Solidarity Fund for the purchase of the first home.
Answering the question 'How can I obtain the suspension of the mortgage on my first home?', it is specified that:
'Whoever meets the requirements for access to the Fund must submit the suspension request to the bank. Thanks to the innovations introduced by the law converting the Liquidity Decree, the bank, having verified the completeness and formal regularity of the documents presented, immediately suspends the charging of the mortgage installments and forwards the request to Consap (public company that manages the Fund on behalf of the Mef). Consap examines the application and communicates its response within 20 days, after which the application is considered accepted (silent assent). If the request is rejected before 20 days, the Bank will start charging the mortgage installments again starting from the one following the suspension request.
The Abi then recalled that the silence-assent mechanism for the approval of requests for access to the Gasparrini Fund introduced during the conversion of Legislative Decree 23/2020, it also applies to applications already submitted, provided they have been submitted to your bank on or after 28 March 2020.
It was also clarified that with the conversion of Legislative Decree 23/2020 the immediate suspension of mortgage installments upon submission of the application.
