SALES ASSIGNMENT GRIMALDI “chose transparency”
The assignment of Sale of a Property still represents today, for those who sign it and beyond the clauses contained therein, an "unconditional act of trust" towards the Real Estate Agent. But if up until a few years ago, or before the entry into force of the art. 15 L. 6 February 1996 n° 52 (containing provisions for the fulfillment of obligations deriving from Italy's membership of the European Communities, Community Law 1944 and which introduced a new article of the Civil Code, 1469 bis) the assignment forms prepared by the Real Estate Brokerage Agencies were in many cases to be signed in the presence of at least one trusted lawyer, today, in compliance with the aforementioned legislation, they should contain (in addition to the agency's obligations to promote effective actions to search for potential buyers) consumer protection clauses. Unfortunately, after 7 years, the "seller" often finds himself faced with unclear forms with many oppressive or even illegal clauses and therefore in conflict with the provisions of 1469 bis of the Civil Code. Grimaldi, since 1978, has prepared a simple sales assignment, easy to interpret, containing obligations for the Real Estate Agency and free from important oppressive clauses, thus making this document "transparent". But as we know, the term "transparency" does not always (or almost never) reflect the reality of the facts and is often used as a sales argument, with the aim of giving greater credibility to one's company, but without being able to actually demonstrate what has been declared. Often the consumer even discovers that behind this term there are hidden pitfalls of various kinds, all to his detriment. For three years now, and for the first time in Italy, the Sales Assignment form used by Grimaldi, after having been subjected to examination by the Chamber of Commerce Commission at the Milan Chamber of Commerce and by some Consumer Protection Associations, has become "transparent" so much so that it has been published in the Group's magazines, on the Internet and in a personalized Brochure distributed to all potential selling customers of a property and available at all the Grimaldi "meeting points" present in the national territory. The booklet presents in facsimile the "PROPOSAL OF ASSIGNMENT FOR THE SALE OF PROPERTY", the illustrated commentary of the most important clauses and the main advertising means used for the promotion of the property and the search for the buyer. A strong signal that Grimaldi wanted to give to his customers who now, before signing it, have the opportunity to read it carefully, comment on it with a possible consultant, verify its reliability, perhaps compare it with others from competing companies and note, once again, that slogans such as "professionalism and seriousness" (dear to Grimaldi) are always followed by concrete and "transparent" facts. A different and original way to distinguish our company, with a rich history of 40 years of success behind it, a well-known, prestigious and clean brand, from other companies that adopt improvisation and lack of clarity as a system and lead customers to give less trust to a category that also includes many good professionals among its ranks.
